1 - yes.
2 - is this a client patch? I don't think it is possible to update all possible experiment CMSSW versions and releases to use new xrootd. I can confirm that with 5.3.1 client it works. So if not possible backport - not a solvable issue.
3 - gfal fails does not matter if 5.x or 4.x xrootd is installed. But this is gfal tool issue, not xrootd
