It think happens with setuptools < 60.0.8 and python 3.9 actually. Regardless of it being ubuntu or macOS.

@ktf Can you verify this? It would be significantly easier to have a discussion around Linux where we can cleanly have minimal failing/working examples in Docker images then trying to attempt to test things in CI workflows if we keep it in macOS only.
