This has been historical and cannot be changed, at least on the xroot side, since people depend on this action. I'm with you on that — I'm also not sure how "hard" the statement in the spec is meant. Since it's not tested in the acceptance tests, my feeling would also be to just ignore it until somebody comes by and makes a strong point out of that.
